Chevy Silverado and GMC Sierra Diesel truck owners from 2011-2016 could be eligible for compensation of up to $12,712 in a fuel pump settlement
In a significant development, a proposed settlement of $35 million is pending final court approval for the class action lawsuit, Chapman, et al. v. General Motors LLC. The lawsuit centres around the premature failure of high-pressure fuel injection pumps (specifically CP4 pumps) in 2011-2016 Chevrolet Silverado trucks equipped with Duramax diesel engines.
The lawsuit alleges that these trucks have a defective fuel pump, which reportedly fails earlier than expected, potentially leading to expensive repairs and vehicle downtime. The case is part of a broader wave of lawsuits concerning multiple safety and performance issues in various GM vehicles.
The settlement aims to compensate affected owners for damages caused by the premature failure of these fuel pumps. As of October 2024, the terms of the settlement beyond the monetary figure and the class of vehicles involved have not been detailed.
For those who wish to be a part of the settlement, it's important to note that the deadline to object to the Settlement is December 12, 2024. If you don't want to be a part of this settlement, you can request exclusion and get out of it by the same deadline.
To receive a cash back payment under the Reimbursement Program, you must obtain and pay for a CP4 repair or replacement at a GM-authorized dealership on or after the date of Final Approval. The Final Approval Hearing will be held on January 21, 2025. The deadline to file a Reimbursement Request Form is 60 days after the date the repair was performed.
The Settlement also includes a Former Owner Fund of $5 million for Class Members who no longer own their trucks and did not pay out of pocket for a CP4 repair. The deadline to file a claim for a cash payment is six months after Final Approval, which could be as early as July 21, 2025. Payments from the Repair Fund could range from $6,356 to $12,712, depending on the number of valid claims received.
The Settlement provides a Partial Repair Reimbursement Program that offers 50% reimbursement of costs paid for a CP4 repair performed at a GM-authorized dealership on or after the date of Final Approval of the settlement. The Settlement is for model year 2011-2016 Chevrolet Silverado and GMC Sierra trucks with a Duramax diesel 6.6L V8 LML engine.
Class Counsel will ask the Court for service awards of $5,000 for each of the 11 Class Plaintiffs. The Settlement does not involve any claims for personal injuries. For more information, visit www.GMFuelPumpLitigation.com, call 1-866-848-0815, or email [email protected].
