Court Decision Solidifies Taxation for Cryptocurrencies in Baden-Württemberg

In a landmark decision, the Finance Court of Baden-Württemberg has ruled in favour of the tax office regarding the taxation of cryptocurrencies. This decision marks the first main proceeding on cryptocurrencies and their taxation in Germany.

The ruling concerns a Bitcoin investor who declared profits from trading cryptocurrencies in his 2017 tax return. The profits were recorded as "income from private sales transactions" by the responsible tax office. Profits on coins held for more than a year are tax-free, according to the court's decision.

The court dismissed the complaint, stating that the "tax law definition of an economic asset" is broad enough to include cryptocurrencies. This means that the status quo remains unchanged: profits from trading cryptocurrencies must be reported as "income from private sales" and taxed accordingly.

The investor had argued that there was no "other economic asset" and a "structural enforcement deficit" in the taxation of crypto trading. However, the court did not recognize a structural enforcement deficit, despite acknowledging the difficulties in detecting income from trading cryptocurrencies due to most trading platforms being located abroad.

Cryptocurrency exchanges are subject to various obligations, including the obligation to verify the identity of customers. This decision sets a precedent for stricter enforcement of taxation of facts related to cryptocurrencies.

Ongoing disputes about FIFO or LIFO, mining, staking, forks, VAT, and DeFi remain unanswered even after the publication of a draft guide by the Federal Ministry of Finance. The German legislature can seek international legal and administrative assistance to obtain necessary information from foreign cryptocurrency exchanges.

The highest court that has not yet decided on the regulation of cryptocurrencies is the Bundesfinanzhof (Federal Finance Court) in Germany. The court has allowed an appeal as the decision-relevant questions have not yet been decided by the highest court. However, special surprises are not expected.

This ruling is significant as it is the first main proceeding decision on cryptocurrencies and their taxation. It solidifies the status quo of taxation for cryptocurrencies in Baden-Württemberg and provides a clearer picture of how profits from trading cryptocurrencies will be taxed in Germany.
