In a landmark decision, the Higher Administrative Court of Baden-Württemberg has ruled that Deutsche Bahn will bear the additional costs of the Stuttgart 21 railway project, which have surged to approximately €11.8 billion. This decision firmly dismisses Deutsche Bahn's attempts to shift financial responsibility to the German state of Baden-Württemberg or the city of Stuttgart.

The State of Baden-Württemberg has been confirmed as not liable for the cost overruns, despite Deutsche Bahn's attempts to hold the state accountable. Similarly, the city of Stuttgart is not required to contribute to the roughly €6.9 billion additional expenditures related to the project.

Courts have firmly discarded Deutsche Bahn's appeals aiming to change the pre-agreed financial responsibilities, despite the substantial increase from initial budgets. This decision means that Deutsche Bahn, as the national rail operator managing the project, must absorb the extra expenses.

In a statement, Deutsche Bahn acknowledged the court's decision and is currently reviewing its legal implications. The company has set aside funds for the Stuttgart 21 project, and the extra costs will not impact other projects of Deutsche Bahn.

The financing agreement from 2009 only covers costs up to around 4.5 billion euros, leaving an additional 6.5 billion euros to be covered by Deutsche Bahn. Deutsche Bahn's initial lawsuits against the state of Baden-Württemberg, the city of Stuttgart, the Stuttgart Region Association, and Stuttgart Airport have also been dismissed.

The court ruling states that project partners are not obligated to share the additional costs of the Stuttgart 21 project. The financing negotiations for the project may be affected by this decision and the additional costs. Deutsche Bahn currently estimates the total costs of the Stuttgart 21 project at around 11 billion euros, with an additional buffer of 500 million euros.
