Restaurant Owner Fined €12,000 for Aiding Illegal Residence

The penalty order of the District Court of Erding is final. In August 2023, a local restaurant owner near me was fined €12,000 for aiding and abetting illegal residence. The case involved three Asian nationals found staying illegally in Germany.

In April 2023, a routine inspection by the Main Customs Office Landshut at an Asian restaurant near me in Erding uncovered two Asian nationals working illegally. They possessed passports and residence permits from other EU countries, but these only allowed a stay of up to 90 days within 180 days, which did not cover employment.

A follow-up inspection in August revealed three more Asian nationals residing illegally. The restaurant owner was subsequently fined for supporting their illegal residence, despite the men having EU passports. The court's penalty order is now final.

The restaurant owner's €12,000 fine is a consequence of aiding and abetting illegal residence. The men, while having EU passports, did not possess the required extended residence or work permits for employment in Europe. The court's final order serves as a reminder of the importance of legal residence and work permits.
