FSU "Rosmorport" Faces Reverse Fine for Abusing Dominant Position in Magadan Port
FSU "Rosmorport," the Russian state-owned corporation responsible for the country's seaports, has been held administratively liable for abusing its dominant position in the Magadan port and setting monopolistically high pilotage fee rates. The Magadan Regional Arbitration Court made this decision in case No. A37-13/2025, a ruling that has not yet entered into legal force.
The court case stems from a violation of antitrust laws, a finding confirmed by courts of three instances (case No. A37-888/2024). In response to the initial administrative fine, FSU "Rosmorport" sought to reduce the penalty through the courts. However, the Magadan Regional Arbitration Court denied the request, upholding a reverse penalty for the corporation.
The reverse penalty, amounting to over 700,000 rubles, was imposed due to FSU "Rosmorport's" abuse of its dominant position in the Magadan port and the monopolistically high pilotage fee rates it set. The corporation may appeal the decision to the appellate instance.
Prior to this decision, the Arbitration Court of St. Petersburg and Leningrad Oblast had rejected FSU "Rosmorport's" lawsuit against the confirmation of the administrative fine on February 1, 2021. The Magadan UFAS Russia's decision to uphold the fine was also deemed lawful by the Magadan Regional Arbitration Court.
Despite FSU "Rosmorport's" attempts to contest the administrative fine, the fine has not been reduced in case No. A37-13/2025. The corporation has the opportunity to appeal the decision, potentially leading to further legal proceedings.
