Row House Settlement Plagued by Persistent Moisture Issues, Court Finds

The court-appointed expert determined that both the basement floor and the staircase of their property are damp. Leak detection revealed water leakages in the plaintiffs' house in the area of the sewage lift.
The developer's 'white tub' design, intended for moisture protection, has failed to prevent water from entering the basements. The continuous floor slab and outer walls have not been sufficient to keep the high groundwater level at bay. Neighbors have also reported similar issues, with moisture damage affecting the basements and walls of their purchased homes.
The court findings highlight the ongoing moisture problems in the row house settlement. Despite the developer's moisture protection measures, homeowners continue to face issues that have rendered their properties uninhabitable. The source of the water ingress remains unclear, as no information is available about which realtor built the affected properties or when they were sold.
