Arbitration Court Showdown Over Contentious Combine Factory Land

Two businesses, OOO "Novoostrovskiy" and OOO "Garant-8," from the Sibiryak group, have brought a lawsuit against Rosimushchestvo (Federal Agency for State Property Management) regarding a disputed land plot on the territory of the Combine Factory without auction in Krasnoyarsk Krai.

The two companies, with OOO "Novoostrovskiy" headed by Vladimir Yegorov, the owner of USK Sibiryak, and "Garant-8" working in the real estate sector, claim that the Interregional Territorial Management of Federal Agency of State Property Management in Krasnoyarsk Krai, Khakassia, and Tyva unjustifiably refused to grant them ownership of a 28,700 sq. m plot on ul. Profsoyuz.

The companies argue that the property qualifies for free allotment since they own a non-residential building (3, str. 8) located on this plot, which was previously a production facility of the combine factory and now houses several offices. They contend that they have the exclusive right to purchase the land without auction.

Rosimushchestvo objects, asserting that the building is in a dilapidated state, and the companies claim it is in good condition and is currently being used. Additionally, the plot is located in the second water extraction layer of the Yenisey River, not the first, and thus cannot be categorized as land withdrawn from circulation. Another argument put forth by the claimants is that the plot's location within a mixed zone of public-commercial and multi-story construction development does not hinder its potential privatization.

In the lawsuit, the claimants have stated that internet publications reporting Sibiryak's plans to construct a housing complex on the site of the old workshop are not grounds for the denial of the land plot. The court is scheduled to decide on the acceptance of the claim for consideration within 5 working days.
